These Terms & Conditions (“Terms”) govern your access to and use of alsatauto.com (the “Site”) and any related services provided by Alsat Auto LLC, a California limited liability company (“Alsat Auto,” “we,” “us,” or “our”). By accessing the Site or contacting us through it, you agree to these Terms. If you do not agree, do not use the Site.

1. About Us

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract under California law to use the Site or purchase a vehicle from us.

3. Vehicle Listings, Pricing, and Availability

We make reasonable efforts to provide accurate vehicle information, including photos, descriptions, mileage, features, condition, and price. However:

• All information is provided “as is” and is subject to change without notice.
• Vehicles are sold subject to prior sale and availability cannot be guaranteed.
• Photographs may not depict the exact vehicle being sold and are for illustration only.
• Mileage shown is current at the time of listing and will increase with use, test drives, and dealer movement.
• Pricing excludes government fees and taxes, any finance charges, any electronic filing charge, any emissions testing charge, and any dealer document processing charge, unless expressly stated otherwise.
• Typographical errors, photographic errors, or pricing errors do not bind Alsat Auto, and we reserve the right to correct any such errors and to refuse or cancel any order based on inaccurate information.

We are not responsible for inaccuracies in third-party data (such as VIN decodes, vehicle history reports, KBB values, or factory equipment lists).

4. Financing Estimates

Any financing payments, interest rates, or loan terms shown on the Site are estimates only and do not constitute an offer of credit. Actual financing terms depend on creditworthiness, lender approval, vehicle, down payment, and other factors. Final terms will be set forth in a written retail installment sales contract or loan agreement signed at the dealership.

Submitting a credit application does not guarantee approval. We share credit information with lenders consistent with our Privacy Policy and federal Gramm-Leach-Bliley Act requirements.

5. Used Vehicle Sales — California Disclosures

All used vehicles are sold subject to applicable California law, including the Automotive Repair Act and the California Vehicle Code. Specifically:

• “AS IS – NO DEALER WARRANTY” unless a written warranty or service contract is provided at the time of sale.
• A separate Buyer's Guide (FTC Used Car Rule) is posted on each used vehicle and becomes part of the sales contract.
• Implied warranties under the Song-Beverly Consumer Warranty Act may apply if the vehicle is sold with an express warranty or service contract.
• A vehicle history report does not guarantee the condition of the vehicle. We encourage all buyers to inspect the vehicle and have it independently inspected by a qualified mechanic prior to purchase.
• Smog certification will be provided as required by California law for vehicles requiring it.

6. 2-Day Contract Cancellation Option (California Auto Buyer's Bill of Rights)

For used vehicles with a cash price of less than $40,000 (excluding motorcycles, recreational vehicles, and off-highway vehicles), California law requires us to offer a 2-Day Contract Cancellation Option Agreement for purchase. The cost and terms of the option will be disclosed in writing at the time of sale. The dealership is not required to offer a cancellation option, and there is no cooling-off period after a vehicle purchase unless you purchase a Cancellation Option.

7. Test Drives

Test drives are offered at our discretion and require a valid driver's license and proof of insurance. By taking a test drive, you agree to:

• Operate the vehicle safely and in accordance with all traffic laws.
• Be financially responsible for any damage, traffic violations, tolls, or losses caused by your operation of the vehicle.
• Sign a separate test drive agreement and liability waiver if requested.

You acknowledge that test driving a vehicle carries inherent risks and that Alsat Auto is not liable for any injury, loss, or damage resulting from your operation of the vehicle to the fullest extent permitted by law.

8. Trade-Ins

If you provide trade-in information through the Site, all valuations are estimates only and are not binding offers. Final trade-in value depends on physical inspection, market conditions, vehicle condition, title status, and outstanding loan payoff.

9. Communications and TCPA Consent

By submitting your phone number through the Site, calling us, or interacting with us, you expressly consent to receive calls, text messages, and prerecorded or autodialed communications from Alsat Auto regarding inventory, financing, service, appointments, and promotions, at the number provided. Consent is not a condition of any purchase. Message and data rates may apply. You may opt out of text messages by replying STOP, or by emailing contact@alsatauto.com.

10. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose.
• Submit false, misleading, or fraudulent information.
• Attempt to gain unauthorized access to any portion of the Site.
• Interfere with the Site's operation, security, or other users.
• Scrape, harvest, or copy Site content without our written permission.
• Use the Site to transmit malware or harmful code.
• Reverse engineer or attempt to extract source code.

11. Intellectual Property

All content on the Site — including text, graphics, logos, photographs, vehicle descriptions, and software — is owned by or licensed to Alsat Auto and is protected by U.S. and international intellectual property laws. You may view and print Site content for personal, non-commercial use only. All other uses require our prior written consent.

“Alsat Auto” and the Alsat Auto logo are trademarks of Alsat Auto LLC.

12. Third-Party Links and Services

The Site may contain links to third-party websites (lenders, manufacturers, vehicle history providers). We are not responsible for the content, accuracy, or practices of those sites.

13. Disclaimers

The Site and all content, information, and materials on it are provided “as is” and “as available” without warranties of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability. Alsat Auto does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

This Section does not affect any non-waivable rights you may have under California law, including under the Song-Beverly Consumer Warranty Act, regarding the vehicles we sell.

14. Limitation of Liability

To the fullest extent permitted by law, Alsat Auto and its owners, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your use of the Site, including loss of profits, data, goodwill, or other intangible losses, even if advised of the possibility of such damages.

Our total liability arising out of or relating to your use of the Site shall not exceed one hundred dollars ($100). Nothing in this section limits liability that cannot be limited under applicable California law.

15. Indemnification

You agree to indemnify, defend, and hold harmless Alsat Auto LLC and its owners, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your misuse of the Site, or your violation of any law or third-party right.

16. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Vehicle sales are also governed by applicable federal law and California Vehicle Code provisions.

17. Dispute Resolution

Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Santa Clara County, California, and you consent to the personal jurisdiction of such courts.

This Section does not apply to disputes arising from the purchase of a vehicle, which are governed by the dispute resolution terms in your retail installment sales contract or purchase agreement (which may include arbitration provisions).

Nothing in these Terms prevents you from filing a complaint with the California Department of Motor Vehicles, the California Department of Consumer Affairs, or any other governmental agency with jurisdiction over motor vehicle dealers.

18. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

19. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy and any signed sales documents, constitute the entire agreement between you and Alsat Auto regarding the Site. Vehicle purchases are governed by separate written sales documents that control in the event of a conflict.
